The Supreme Court to hear the petitions against the super tax tomorrow

The seat of the Constitutional Supreme Court is scheduled to guide the petitions against Section 4b and 4 EGP of the Income Tax Decree (ITO), 2001, in relation to the high tax, on Monday.

It will also deal with a seat consisting of five members, led by Judge Amin Al -Din Khan, the breathing request submitted by the Bar Association in the Peshawar Supreme Court (Mingora), which challenges the twenty -fifth constitutional amendment as super.

More than 400 petitions against the amendments were made to the income tax decree, which provided the superb tax to finance the rehabilitation of temporary displaced persons (TDPS) in the aftermath of the Zarb-E-ZB military operation in northern Waziristan. The tax, which was imposed through the 2015 Finance Law, affects individuals, associations and income companies that exceed 500 million rupees, which offers 4 % on banking companies and 3 % on others.

Ijaz ahmed Awan, which represents many taxpayers, argues that TDP rehabilitation funds must be included under the regional field according to the eighteenth amendment, and claims that the super -unconstitutional tax and lacks legitimate tax properties. He also confirms that the tax has imposed through an inappropriate process, bypassing the standard measures required for such fees, and violating constitutional provisions, especially Article 25, on equal treatment under the law.

Awan asked the court to allocate the Supreme Court’s decision in Lahore on this issue.
